Terms of Service
October 15, 2026
These Terms of Service govern the use of the StoryTime website and the terms on which digital content (a personalized digital storybook) and goods (a personalized printed storybook) are ordered and supplied.
Contact the service provider ("we", "us") at kontakt@storytimebooks.pl.
By using the Service - in particular by uploading a photo and generating a Character or Book - you confirm you have read and accept these Terms and the Privacy Policy.
These English Terms are a translation provided for convenience. In case of any discrepancy between language versions, the Polish version governs, as the Service is operated under Polish law.
1. Definitions
- Service - the StoryTime web application available at the address where these Terms are published.
- User - a natural person using the Service, with full legal capacity.
- Consumer - a User who is a consumer under Polish law, and, where applicable, a sole trader entering into a contract directly related to their business where the contract is not of a professional nature to them.
- Account - a User's individual account in the Service, secured by an email address and password.
- Character - a character profile a User creates in the Service from an uploaded photo and description, together with the generated illustrations of that character in the chosen styles.
- Book - a personalized, AI-generated illustrated story made of a cover and pages, built from a Character and a chosen occasion, available as a digital download and orderable in print.
- User Content - in particular the uploaded reference photo and any text entered by the User (name, relation, outfit, traits, text edits).
2. Using the Service
- The Service may be used by a person who is at least 18 years old and has full legal capacity.
- Creating an Account requires a genuine, active email address and a password. You must keep your password confidential and are responsible for activity carried out using it.
- An Account may only be used by the person who created it.
3. Scope of the Service
The Service lets you: (i) create a Character from an uploaded photo and description, using generative AI to produce stylized illustrations; (ii) generate an accompanying story using AI, based on a chosen occasion and the Character's traits; (iii) combine these into a personalized Book, with the ability to edit text and regenerate individual illustrations within the limits described in the Service; (iv) download the finished Book as a digital file (PDF/EPUB).
A Book can also be ordered as a printed hardcover, in the sizes shown in the Service. A printed order includes the digital edition.
Some features (e.g. lower-resolution style previews) may be free and subject to limits (e.g. a daily limit of free generations that resets at midnight), as indicated in the Service. An ordered book includes a pool of illustration edits in its price; once it is used up, further edits are available by contacting us.
4. User Content, likeness, and your responsibility for what you upload
By uploading a photo and other User Content, you represent that:
- it shows you, or a person whose image you have the right or permission to use as described in these Terms (processing by AI models to create an illustrated Character and include it in a Book, including sending the photo to a third-party AI provider solely for that purpose);
- if that person is a minor, you are their parent or legal guardian, or have that guardian's explicit permission;
- the content you upload does not infringe third-party rights (including copyright, personality rights, or image rights) or applicable law, and in particular contains no unlawful, abusive, hateful, or sexual content involving minors.
We reserve the right to refuse to generate or to remove a Character/Book, and to suspend or terminate an Account, where we reasonably suspect a breach of the above, and will notify the User where practicable.
You are solely responsible for the lawfulness of the User Content you upload and will hold us harmless from third-party claims arising from a breach of the above representations, to the extent permitted by applicable law (including consumer-protection law).
5. The nature of AI-generated content
Book illustrations and text are generated automatically by third-party AI models from the information you provide. We aim for generated illustrations to faithfully resemble the person in the photo, but given the nature of AI technology, we cannot guarantee photographic accuracy or an identical result on every generation - the output is a creative, stylized interpretation.
Generated content may occasionally contain technical imperfections (e.g. anatomical artifacts in an illustration) or inaccuracies in the text. Where a free/pre-purchase preview is offered, you can review the result before finalizing your order and, within the available limits, request a re-render.
6. Rights in the generated content
Once you finalize an order (paying for a digital or printed edition), we grant you a license to use the Book generated for you (illustrations and text) for personal, non-commercial purposes - including printing it for personal use, sharing it with family and friends, and posting excerpts on social media with attribution to the Service. Commercial use of generated content (resale, use in third-party products or services) requires our separate written consent.
Given the nature of generative AI, we cannot guarantee that every generated illustration is fully original or rule out incidental resemblance to existing works. We take steps to reduce this risk, but to the extent permitted by law we are not liable for such incidental resemblance unless it results from our willful misconduct or gross negligence.
7. Pricing and payment
Current prices (digital edition, printed edition, delivery) are shown in the Service before you place an order. Prices are in Polish złoty and are final prices - they include VAT where required by law.
Payment is made upfront in the Stripe (Stripe Payments Europe, Ltd.) payment window shown in the Service: by card, BLIK, Przelewy24 transfer or another method shown there. We never see your card or bank login details. The contract is concluded once Stripe confirms the payment.
The digital edition is available in your Account as soon as the payment is confirmed. Printed books ship to addresses in Poland only; printing and delivery usually take 5-8 working days from payment, and the delivery cost is added and shown before you pay.
Subscriber discount: a User with an Account who agreed to receive StoryTime news and discounts by e-mail gets a discount on their next books - 10% on the second, 15% on the third and 20% on every further paid book. It is taken off the current price of the digital edition (a promotional price included), does not cover printing or delivery and does not combine with a discount granted individually (the better one applies). It applies only while the consent is active at the time of the order; after it is withdrawn, the next books cost the current price. The discounted price is shown before you pay.
8. Consumer right of withdrawal
A Consumer who enters into a distance contract with us generally has the right to withdraw from it within 14 days without giving a reason, under the Polish Consumer Rights Act of 30 May 2014.
Statutory exceptions apply, however, to the services offered in this Service:
Printed Book (personalized goods)
Under Art. 38(3) of the Consumer Rights Act, the right of withdrawal does not apply to contracts for goods that are not prefabricated, made to the consumer's specification, or clearly personalized. Every printed Book is individually generated from a specific Consumer's photo, description, and choices - it is therefore a personalized product within the meaning of that provision, and no change-of-mind withdrawal right applies to it.
Digital Book (digital content)
Under Art. 38(13) of the Consumer Rights Act, the right of withdrawal does not apply to contracts for digital content not supplied on a tangible medium, for which the Consumer is obliged to pay, where we began performance with the Consumer's prior express consent, given after being informed that they would thereby lose the right of withdrawal, and having acknowledged that. When finalizing a digital order, the Service collects this separate, explicit confirmation from the Consumer; once given and the file made available for download, the right of withdrawal lapses.
What these exceptions do NOT limit
The exceptions above apply only to the "no-reason" withdrawal right (i.e. change-of-mind returns). They do not in any way limit our statutory liability for defects (rękojmia under the Polish Civil Code, Art. 556 et seq.) or the rules on conformity of digital content with the contract - if the Book you receive is defective (e.g. damaged in transit, a printing or binding defect, or a corrupted or non-conforming digital file), you retain the right to file a complaint as described in the next section. This right cannot be excluded or limited by these Terms.
9. Complaints
Complaints about a Book not matching your order, or about defects (including printing/binding defects, transit damage, or a defective digital file), can be sent to kontakt@storytimebooks.pl, including: your name, contact details, order reference, a description of the issue, and your requested resolution.
We review complaints and respond within 14 days of receipt. If we fail to respond within that period, the complaint is deemed accepted.
10. Out-of-court dispute resolution
- A Consumer may use out-of-court complaint and redress mechanisms, including seeking help from their local county/municipal consumer ombudsman (powiatowy/miejski rzecznik konsumentów) or the relevant Trade Inspection authority (Inspekcja Handlowa).
11. Our liability
We take reasonable care to keep the Service running correctly and continuously, but cannot guarantee uninterrupted availability of third-party AI models we don't control. If a generation is unavailable or fails, you may retry or contact us.
To the extent permitted by applicable law, including mandatory consumer-protection law, our liability to a Consumer is not limited beyond what the law allows; toward Users who are not Consumers, our liability is limited to actual losses (excluding lost profits) and capped at the price paid for the relevant Book.
12. Prohibited conduct, suspension and termination
- using the Service unlawfully, contrary to good practice, or in breach of these Terms, including uploading User Content that infringes third-party rights,
- attempting to circumvent the Service's technical safeguards, including free-generation limits (e.g. via automation, creating multiple accounts, or spoofing an IP address),
- using the Service in a way that disrupts it for other Users.
We may suspend or terminate an Account that breaches the above, without prejudice to a Consumer's rights under contracts already concluded and paid for.
13. Changes to these Terms
We may amend these Terms for good cause (a change in the scope of the Service, a change in law, or to counter abuse). Changes do not affect rights already acquired under contracts entered into before they take effect. Account holders will be notified of changes with reasonable advance notice.
14. Final provisions
Contracts made through the Service are governed by Polish law. This choice of law does not deprive a Consumer of protection granted by provisions that cannot be excluded by agreement under the law of their habitual residence.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect.
